TABC:Mobile Privacy Statement

Neubus, Inc. (“Neubus”) knows that you care how information about you is used and shared. This notice describes Neubus’s Privacy Statement for the mobile application TABC:Mobile (the “Application”).

Privacy

Neubus restricts access to information to technical debugging services and the Texas Alcoholic Beverage Commission (hereafter “TABC”) via the TABC: Mobile Application. Neubus maintains physical, electronic and procedural safeguards to protect information provided to TABC. These safeguards include limiting access to data and routinely testing our security technology. If you have questions regarding your information, we welcome you to contact TABC at [email protected] and TABC will respond within a reasonable time.

Registration
Registration is not required unless you use the “report of breach of peace” function. You must be a license/permit holder or authorized employee of a license/permit holder and you will be required to provide your name, e-mail address, and a valid license / permit number to use this function.
During registration, you will be required to provide contact information consisting of [email protected].
You may select any username you want. Exceptions are that your username cannot be an impersonation, the same or confusingly similar to a famous trademark, or be a term that is offensive in any way. You may, but are not obligated to, use your own name. You consent to your username being passed to the TABC by use of the functions of the Application. Neubus reserves the right to reject or remove any username that does not meet applicable standards.

Cookies
A cookie is a small text file that is stored on a user’s computer or mobile device for record-keeping purposes. Neubus may make use of cookies within or together with the Application.
Your device may allow you to control and limit cookies. If you reject cookies, you may still use the Application, but your ability to access and/or use some functions of the Application may be limited.
No Neubus’ business partners (including advertisers) may use cookies within or together with the Application, aside from services that assist with debugging.
Significant Announcements by Email
Neubus shall not use your registered name and email address to provide you with significant announcements about Application functions or services that you are registered to use, about this Application, about any user account you may create, or about other significant developments that may affect your use of the Application, aside from communication to confirm one’s submission of information to the app.

Additional Information for Specific Purposes
This application may collect precise information about the location of your device. Neubus may use your location information to provide you requested location information.
With approval from TABC, Neubus may work with analytics companies to help us understand how the Application is being used, such as the frequency and duration of usage.
Except for the use of the “report of breach of peace” function, you may remain anonymous. If you choose to disclose your identity or other information to the TABC using any application function or service, you do so at your own risk.
Neubus is responsible for the privacy or security of any information, personal or otherwise, that you may choose to communicate or exchange using the functionality of the Application.

Feedback to Neubus
Neubus may provide feedback only on the functionality of the Application. You may submit your comments, suggestions, or bugs found to Neubus. Neubus may collect your name or username and email address in order to follow up with you or thank you for a suggestion.

Anonymous Data
With approval from TABC, Neubus may track the Application to analyze trends, administer the Application, track your actions and use of the Application, record transactions, and gather demographic information for aggregate use. Neubus shall not share aggregated demographic and usage information with anyone but TABC. This aggregated information is not linked to any personal information that can identify any individual person.

Links
The Application shall not contain links to or information regarding other applications or websites except for links to the TABC website.

Correction/Updating of Personal Information
If you provide personally identifiable information, Neubus will provide a way to correct, update, or edit your personal data. For e-mail address changes, you will be required to delete the TABC:Mobile application, re-install and re-register your information.

Protection of Minors
Neubus strictly adheres to The Children’s Online Privacy and Protection Act of 1998. For that reason, we do not collect or maintain information obtained through our Application from those we actually know are under 13, and no part of our Application is structured to attract anyone under 13. Children under the age of 13 are not permitted to register this Application or use any functionality for which registration is required.

Business or Asset Transfer or Sale
Neubus may be sold, might sell or buy businesses or assets of businesses, or Neubus might merge with another business. In such transactions, customer information shall not be one of the transferred business assets. Also, in the event that Neubus, a line of business of Neubus, or substantially all the assets of Neubus are transferred, customer information shall not be one of the transferred assets.

Release of Information for Legal Reasons
Neubus shall not release information concerning your use of the Application (including, but not limited to, content, registration information, and network records) without obtaining prior written permission from TABC. TABC will not unreasonably withhold permission in appropriate circumstances.

Limited Use
Neubus shall not sell, share, or rent information obtained through this Application.

Changes in This Privacy Policy
If Neubus decides to change this Privacy Statement, Neubus will notify the TABC and upon approval by TABC will update the TABC: Mobile application.

Data Retention Policy
Neubus will retain user provided data pursuant to TABC policy and procedure. Neubus shall not delete data that you have provided via the Application. Please note that some or all of the data may be required in order for the Application to function properly, and we may be required to retain certain information by law.

If you reside outside the U.S. your information will be transferred to the U.S., and processed and stored there under U.S. privacy standards. By using the Application and providing information to us, you consent to such transfer to, and processing in, the US.
